Consumer Terms & Conditions of Supply

This page sets out the terms and conditions of sale which apply to the purchase of any of the products or services listed on our website.

Please read through these terms and conditions thoroughly to ensure you have understood them before ordering any products from our site. When placing an order on our website you will be presented with a box which you asks you to agree with these terms and conditions. Please put a tick in the box marked “I have read and agree to the Terms & Conditions” during the ordering process only if you accept them and that you agree to be bound by them. If you do not agree to the terms and conditions set out then you will not be able to order any products from our website.

Our site is only intended for use by adults who resident in the United Kingdom (mainland only) and we reserve the right to not accept orders from individuals who resident elsewhere. Only adults are permitted to purchase products from our store but they may purchase goods for children as long as the products purchased are intended for use by children by the manufacturer of the goods.

By placing an order through our website, you agree that:

  • You are resident in the United Kingdom (mainland only)
  • You are accessing our site from the United Kingdom (mainland);
  • You are legally capable of entering into a binding contract;
  • You are at 18 years old or over.

  
Pricing of Products and Title of Ownership
All prices published on our website are in British Pounds.
We try to ensure all prices displayed on our website are current and correct but in the rare event of an error we reserve the right to either cancel, change or amend your order and may also contact you to arrange any additional payment required or refund any over-payment made by you (if applicable).
We reserve the right to alter any product pricing without notice.
The title of any product ordered via our website does not pass to you, the purchaser until we have received and processed a valid payment, and the payment has been received (and cleared) our own bank account.
We reserve the right to cancel, correct or change any order up until the goods have been paid and actually dispatched.

Your Order
When you place an order on our website you will receive an automatic confirmation of order by email, this confirms that your order has placed and does not indicate that it has been accepted by us.
Your order constitutes an offer made to us to purchase the goods detailed on the order.
Your offer is only accepted by us once we have physically dispatched your order. Any products which have not been dispatched are not included in the order and contract between you and us; this remains the case until such time as they are dispatched.
We reserve the right to refuse orders or to delay them if the transaction contains details which are incomplete or need to be verified.
In the case where we feel fraud is suspected, we reserve the right to cancel the transaction and reverse any transaction already placed, without notice.
We may ask for confirmation of address or identity and hold orders until such time as we are satisfied that we have the correct information, this is at our descression.
If we are unable to reasonably ascertain these details or resolve these issues a full refund will be made against the original payment method. No other form of refund or credit will be offered.
You should always check that the contact information you provide is correct before proceeding to payment.

Shipping, Tax and Customs Duty
At this time we ship to mainland UK addresses only.
All orders received by us are shipped subject to stock availability, we try to ensure our website shows the correct stock status at all times but can not be accountable if an item is actually out of stock where the website shows otherwise, if this is the case we will contact you to ask if you wish to wait for the item to come in to stock or offer you a refund for the goods.
If an item is out of stock at the time of purchase we reserve the right to ship products at a later date (up to 28 days after the actual purchase). After this date we will contact you and ask if you wish to wait a further amount of time or if you wish for a full refund instead of delivery of the product.
Goods purchased from our website are delivered by a variety of different methods and depending on the goods purchased will depend on the delivery method we use.
We reserve the right to change any delivery method to a more appropriate or safer method as we feel fit.
We try to deliver all goods within the time frame stated at the point of sale, unless the item is out of stock in which case we will contact you about this.
We cannot be held responsible for delays in delivery due to bad weather conditions, industrial disputes or action outside our direct control. If such disruption occurs you will be offered delivery via an alternative delivery method or offered a full refund.
At this time we do not ship products outside of mainland UK but if we do the customer is fully responsible for all customs duties, taxes of other charges incurred in the receiving country to which the products are shipped. There may also be delays due to customs authorities or security searches by courier companies which we can not be accountable for and any such delays are not our responsible nor can we be held accountable in such instances.
At this time we are not VAT registered so any prices shown on our website are deemed to be "the price" and are not eligable to have VAT recovered from them.
Any goods sold have already had any VAT or Duty paid on them by us.

Consumer Rights (Cancellations and Your Right to Cancel)
Under the Distance Selling Regulations you have the right to cancel your order within a time period (know as the cooling off period).
You may cancel your order at any time within the first 14 days from the date your goods are delivered to you.
In order to cancel your order you must notify us in writing (by email or letter) within the 14 day period, stating you wish to return the goods for a refund.
This cancellation right can only be used for physical goods.
The goods must be return to us at the buyers cost. It is advisable to return the goods safely via a recorded (signed for) service to ensure their safe arrival).
We will not issue refunds for any items lost or stolen in transit to us.
Goods can only be returned under this cancellation right if they are brand new, unopened and unused goods.
Any goods which have been opened can not be accepted.
All goods must come back exactly the way they left us and in perfect condition.
If you are returning batteries, they must be unused, unmarked (not scratched or damaged in any way), they must not have been charged or discharged and be in resalable condition.
Once we receive the goods back we will notify you and process the refund via the original payment method.

Returns, Replacements and Refunds
All products sold on our website come with a 12 months warranty against manufacturing defects from date of delivery (UNLESS OTHERWISE STATED ON THE DESCRIPTION) with the EXCEPTION OF BATTERIES (See Below).
Some items may come with a longer warranty which is covered by the manufacturer of the goods; any such warranty will be indicated on the description page for the product.
In all cases please check the items description to see what warranty applies to the goods you have purchased.

Damages on Delivery:
If any product is damaged on delivery you must notify us of this within 5 working days.

Faults/Defects within the firsts 30 days:
If a product is defective on delivery or develops a fault within the first 30 days you must notify us of this in writing (by email, letter or via our website), we will then confirm that we have received your request and advise of what to do next.
You will be given an RMA number which you will need to use when the goods are returned back to us and we will advise you of how to return the goods safely.
If you have bought from our website you may use the returns system to raise the appropriate returns documents and we will acknowledge this.
We will need to the goods to be sent back to us in order to process any valid returns claim and a document with the RMA number must be sent back with the goods and/or the RMA number clearly marked on the package for us to process the claim.
In the first 30 days after delivery if a product is defective, the cost of returning the product is paid by us.
We will advise of the best and safest way to send the goods back and will cover the cost of this (within the first 30 days).
It is your responsibility to ensure the goods are packaged well as no claim can be made if the goods arrive back with us damaged due to poor packing by you, it is best to use the original packaging if possible to avoid problems.
We can not be accountable for any goods that you are sending back to us which are lost in the post.
The goods must be returned complete with all original accessories, cables, documentation and any other parts which were included, otherwise we can not grant your claim.
When we have received your goods back we will notify you (and update they system if you have used our online system for the return).
Within the first 30 days once the goods successfully returned to us and your warranty claim has been validated, you may select to have either a replacement (if one is available) or full refund for the original purchase price.

After the first 30 days:
If after the first 30 days your product develops a fault and the product is covered by a further guarantee period (e.g. up to 12 months or 24 months), then you may return the goods back to us.
Any returns after the first 30 days must be done so AT YOUR COST.
You must use the same procedure to notify us of such a warranty claim and we will respond to your request.
Any goods sent back after the first 30 days will be done so at your cost and must be sent securely packaged to avoid damage as we can not be accountable for damaged received or items lost in the post (it is advisable to use a recorded delivery method for your own safety).
Once we have your product back we will advise you of this and depending on the fault will depend on what action will be taken.
If the product is covered by the manufacturer's guarantee it may be that the goods need to be sent back to the manufacturer for repair or verification of the fault, we will cover any cost involved for this.
If the goods need to be sent back to the manufacturer you must allow "reasonable time" for this to take place.
If the goods are covered by warranty we or the manufacturer have the right to repair or replace any goods as we/the manufacturer feel fit and if we/the manufacturer are unable to repair or replace any items we/the manufacturer have the right to offer you similar or equal goods to the same (or better) specification and value, if they are available.
We can not accept goods back if they have clearly been abused, mistreated or used in a way which is not in line with the manufacturer’s instructions; if this is the case any such items will not be covered under any such warranty and will be return back to you.
We do not give any additional warranty on unprotected batteries after the first 30 days, this is due the fact they can easily be damaged and misuse.
In all cases we do not pay any return postage cost for international transactions no matter what time scale.

Warranty on Batteries

This section is split in to two categories and applies to all batteries sold:

  1. Protected Batteries
  2. Unprotected Batteries

Warranty Protected Batteries
All batteries sold on our website are of a very high quality, we only sell genuine products which use high quality cell inside. Therefore we offer a 12 month warranty on all protected batteries sold. This covers against manufacturing defects or failures from date of delivery during normal use. It DOES NOT cover batteries which have been abused, over charged, over discharged or show any signs of misuse, it also does not cover a degradation of the battery's capacity as this is normal and over time a battery will lose it capacity over its life.

Warranty UnProtected Batteries
All unprotected batteries sold on our website are of a very high quality, we only sell genuine products which use high quality cells. Due to this and the very high quality control there is very little chance of an unprotected battery being defective when it is delivered. Due to this and the fact that it is very easy to damage an unprotected battery we offer a 30 day warranty on them. This gives the user 30 days grace to use the battery an ensure it is without defect. This warranty covers against manufacturing defects or failures from date of delivery during normal use. It DOES NOT cover batteries which have been abused, over charged, over discharged or batteries which has been used outside its working capability (i.e. had too much current/drain taken from them), or show signs of misuse.

Usage and Risk
We will not be held accountable under any circumstances for the misuse of any products on our website, responsibility lies solely with the end user.
Failure to use any product as it is intended is done solely at the end users risk.
It is the end users responsibility to educate themselves about the product before purchase and use caution and care when using the product. This is especially important with Batteries and the appropriate caution must be taken at all times.

Jurisdiction
These Terms & Conditions shall be interpreted, construed and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.
